The bill would amend the Code of Criminal Procedure to allow any magistrate in the county in which a defendant is arrested to order the release of that defendant after an arrest on a violation of a condition of community supervision under certain circumstances. Under current law, only the judge who authorized the arrest may authorize the defendant's release. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished within existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
