The bill would amend the Family Code and the Penal Code relating to regulating the custody transfer of an adopted child. Based on information provided by the Department of Family and Protective Services, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.The bill would also amend the Penal Code to create a criminal offense for the unregulated custody transfer of an adopted child and expands the definition of the offense of advertising for the placement of a child. This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact on state correctional agencies.The bill would take effect September 1, 2017. Local Government Impact According to the San Antonio Police Department, the fiscal impact to implement the provisions of the bill is not anticipated to be significant.
