                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            April 27, 2017      TO: Honorable Drew Darby, Chair, House Committee on Energy Resources      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:HB891 by Raymond (relating to the creation of the offense of theft of petroleum product.), Committee Report 1st House, Substituted    No significant fiscal implication to the State is anticipated.  The bill would amend the Penal Code to define and prohibit theft of petroleum products.  The bill would make it an offense for any person to unlawfully appropriate a petroleum product with intent to deprive the owner of that product.  Classification of the offense would depend on the value of the unlawfully appropriated petroleum product.  Based on the analysis of the Office of Court Administration, the Comptroller, and the Railroad Commission, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
