A section of the Water Code continues to require May elections for water district board members; however, it creates confusion concerning which code governs. H.B. 999 corrects this inconsistency by amending the Water Code to allow water districts to hold November elections, as previous legislation permitted.   H.B. 999 amends current law relating to requiring the election of directors of certain districts to be held on a uniform election date.   RULEMAKING AUTHORITY   This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.   SECTION BY SECTION ANALYSIS   SECTION 1. Amends Section 49.103(b), Water Code, as follows:    (b) Requires that an election, unless a district or authority (district) holds its general election for officers on a date as otherwise provided by statute, after confirmation of a district, be held on the uniform election date, provided by Section 41.001 (Uniform Election Dates), Election Code, in May of each even-numbered year to elect the appropriate number of supervisors or directors to the governing board of a district. Makes a nonsubstantive change.    SECTION 2. Effective date: September 1, 2017.

AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

In 2011, the Election Code was amended to allow multiple entities, including water districts, to move their elections to November. A section of the Water Code continues to require May elections for water district board members; however, it creates confusion concerning which code governs. H.B. 999 corrects this inconsistency by amending the Water Code to allow water districts to hold November elections, as previous legislation permitted.
