The bill would amend the Human Resources Code to authorize a physician, or a person delegated prescribing authority by a physician, to prescribe epinephrine auto-injectors in the name of a day-care center, and require a physician, or a person delegated prescribing authority by a physician, to provide a day-care center with a standing order for the administration of an epinephrine auto-injector to a person reasonably believed to be experiencing anaphylaxis. The bill would require that each day-care center is responsible for training personnel in the administration of an epinephrine auto-injector. The bill would take effect immediately upon receiving a two-thirds majority vote of both houses. Otherwise, the bill would take effect September 1, 2017. Based on the LBB's analysis of the Health and Human Services Commission, Board of Pharmacy, and Texas Medical Board, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
