The bill would amend the Health and Safety Code as it relates to certain substances listed in Penalty Group 2 of the Texas Controlled Substances Act. Under the provisions of the bill, a subsection of Penalty Group 2, specifically addressing substances approved by the Federal Drug Administration, would be repealed to align the Penalty Group with the other Penalty Groups within the Texas Controlled Substances Act.The Department of Public Safety indicates the provisions of the bill could be implemented within existing resources. This analysis assumes the provisions of the bill addressing felony sanctions would not result in a significant impact on the demands for state correctional resources. The bill would take effect on September 1, 2017 and apply only to offenses committed on or after the effective date of the Act.
