As proposed, S.B. 685 amends current law relating to the standard service retirement annuity for certain members of the elected class of the Employees Retirement System of Texas. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 814.103, Government Code, by amending Subsection (a), and adding Subsection (c), as follows: (a) Provides that except as provided by Subsection (b) (relating to prohibiting certain standard service retirement annuities from exceeding a certain amount), the standard service retirement annuity for service credited in the elected class of membership for a person described by Section 812.002(a)(3) (relating to membership in the elected class of the Employees Retirement System of Texas (ERS) for district and criminal district attorneys) is an amount equal to the number of years of service credit in that class, times two percent of the state salary, excluding longevity pay under Section 659.0445 (Longevity Pay for State Judges and Justices) and as adjusted from time to time, being paid a district judge. (c) Provides that the standard service retirement annuity for service credited in the elected class of membership for a person described by Section 812.002(a)(1) (relating to membership in the elected class of the retirement system for persons holding certain offices filled by statewide election) or (2) (relating to membership in the elected class for members of the legislature) is an amount equal to the number of years of service credit in that class, times two percent of the state salary being paid a district judge on August 31, 2017, excluding longevity pay under Section 659.0445. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2017.
