                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            March 20, 2017      TO: Honorable John Whitmire, Chair, Senate Committee on Criminal Justice      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:SB773 by Uresti (Relating to the authority of a judge to compel a criminal defendant who lacks capacity to take psychoactive medication.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Health and Safety Code to allow a judge to order a defendant to take psychoactive medication if the defendant lacks the capacity to make a decision regarding administration of the proposed medication. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
