                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION            March 30, 2017      TO: Honorable Charles Perry, Chair, Senate Committee on Agriculture, Water & Rural Affairs      FROM: Ursula Parks, Director, Legislative Budget Board     IN RE:SB862 by Perry (Relating to the award of attorney's fees and other costs in certain proceedings involving a groundwater conservation district.), As Introduced    No significant fiscal implication to the State is anticipated.  The bill would amend the Water Code to permit any prevailing party to recover attorney's fees and costs in any suit or enforcement action to which a groundwater conservation district is a party. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. Local Government Impact No significant fiscal implication to units of local government is anticipated.
