Many of these retailers are modifying some of their business operations to include food and/or beverage service. S.B. 888 seeks to clarify existing provisions in the Lottery Act in order to continue these licensures. As proposed, S.B. 888 amends current law relating to the sale of lottery tickets by certain wine and beer retailers. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 466.155(a), Government Code, as follows: (a) Requires the director of the Lottery Division (director) to deny an application for a license after a hearing, or require the Texas Lottery Commission (commission) to suspend or revoke a license if the director or commission, as applicable, finds that the applicant or sales agent, among other criteria, is a person whose location for the sales agency is a location for which a person holds a certain permit issued under certain chapters of the Alcoholic Beverage Code, other than a location for which a person holds a wine and beer retailer's permit issued under Chapter 25 (Wine and Beer Retailer's Permit), Alcoholic Beverage Code, that derives less than 30 percent of its gross receipts from the sale or service of alcoholic beverages at the location. SECTION 2. Effective date: upon passage or September 1, 2017.
