 A BILL TO BE ENTITLED
 AN ACT
 relating to the facilitation of a funeral procession by a vehicle
 escort service.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 546, Transportation Code, is amended by
 adding Subchapter D to read as follows:
 SUBCHAPTER D. FUNERAL ESCORT SERVICE VEHICLES
 Sec. 546.101.  DEFINITION. In this subchapter, "funeral
 escort service" means a business that facilitates the movement of
 traffic for a funeral procession.
 Sec. 546.102.  LIMITATION ON LOCAL AUTHORITIES. A local
 authority may not prohibit a funeral escort service from
 facilitating the movement of traffic for a funeral procession.
 Sec. 546.103.  OPERATION OF FUNERAL ESCORT SERVICE VEHICLES.
 An operator of a vehicle facilitating the movement of a funeral
 procession for a funeral escort service may proceed past a red or
 stop signal or stop sign, after slowing as necessary for safe
 operation.
 Sec. 546.104.  DUTY OF CARE. This subchapter does not
 relieve the operator of a funeral escort service vehicle from:
 (1)  the duty to operate the vehicle with appropriate
 regard for the safety of all persons; or
 (2)  the consequences of reckless disregard for the
 safety of others.
 SECTION 2.  This Act takes effect September 1, 2019.
