86R2075 MCK-D By: Miller H.B. No. 1780 A BILL TO BE ENTITLED AN ACT relating to the mandatory dismissal date of certain suits affecting the parent-child relationship involving the Department of Family and Protective Services. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 263.401, Family Code, is amended by adding Subsection (b-2) to read as follows: (b-2) When considering under Subsection (b) whether to find that extraordinary circumstances necessitate the child remaining in the temporary managing conservatorship of the department for a case in which the court orders a parent to complete a substance abuse treatment program, the court shall consider whether the parent made a good faith effort to successfully complete the program. SECTION 2. The changes in law made by this Act apply to a suit affecting the parent-child relationship filed before, on, or after the effective date of this Act. SECTION 3. This Act takes effect September 1, 2019.
