No. 2705 A BILL TO BE ENTITLED AN ACT relating to job order contracting for certain airport facilities by certain joint airport boards. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 2269.402, Government Code, is amended to read as follows: Sec. 2269.402. APPLICABILITY OF SUBCHAPTER TO BUILDINGS; EXCEPTIONS. This subchapter applies only to a facility that is a building, the design and construction of which is governed by accepted building codes, or a structure or land, whether improved or unimproved, that is associated with a building. Except as provided by Section 22.0741, Transportation Code, this [This] subchapter does not apply to: (1) a highway, road, street, bridge, utility, water supply project, water plant, wastewater plant, water and wastewater distribution or conveyance facility, wharf, dock, airport runway or taxiway, drainage project, or related type of project associated with civil engineering construction; or (2) a building or structure that is incidental to a project that is primarily a civil engineering construction project. SECTION 2. Subchapter D, Chapter 22, Transportation Code, is amended by adding Section 22.0741 to read as follows: Sec. 22.0741. JOB ORDER CONTRACTING BY CERTAIN JOINT AIRPORT BOARDS. (a) This section applies only to a joint board: (1) for which the constituent agencies are populous home-rule municipalities; and (2) that operates a facility that is: (A) an airport roadway, bridge, runway, taxiway, or related type of project associated with civil engineering construction; or (B) a building or structure incidental to a facility described by Paragraph (A). (b) Notwithstanding Section 2269.402, Government Code, a joint board to which this section applies may award a job order contract as provided by Subchapter I, Chapter 2269, Government Code, for the maintenance, repair, alteration, renovation, remediation, or minor construction of a facility described by Subsection (a)(2) if the individual job, task, or purchase order for the maintenance, repair, alteration, renovation, remediation, or construction does not exceed $300,000. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2019.
