LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION April 11, 2021 TO: Honorable James B. Frank, Chair, House Committee on Human Services FROM: Jerry McGinty, Director, Legislative Budget Board IN RE: HB1098 by Gates (Relating to reports of child abuse or neglect and certain preliminary investigations of those reports.), As Introduced No significant fiscal implication to the State is anticipated. The bill would amend Family Code to require certain information in a report and notice and require a Department of Family and Protective Services (DFPS) representative to take certain actions when receiving anonymous reports of abuse and neglect. The bill would also require in cases where a report is referred to DFPS by 9-1-1 or a law enforcement agency, that a preliminary investigation must take place including what is allowed during these investigations. Based on analysis by DFPS, it is assumed that the costs associated with implementing the provisions of the bill could be absorbed within existing resources.
