                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             March 22, 2021       TO: Honorable Victoria Neave, Chair, House Committee on Juvenile Justice & Family Issues     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB1401 by Johnson, Ann (Relating to methods to send applications and orders for sealing juvenile records.), Committee Report 1st House, Substituted     No significant fiscal implication to the State is anticipated. The bill would amend the Family Code to allow a person to file an application for sealing records with a juvenile court using any reasonable method, including secure electronic means, that are authorized under Rule 21 of the Texas Rules of Civil Procedure. The bill would also permit the clerk of a juvenile court to send copies of the court's record sealing order to various entities by secure electronic means and would delete the option to send sealing orders via regular mail or email.Based on the analysis of the Office of Court Administration and the Juvenile Justice Department, it is assumed that duties and responsibilities associated with implementing the bill could be accomplished utilizing available resources. In addition, no significant fiscal impact to the state court system is anticipated with the implementation of the bill.  Local Government ImpactNo significant fiscal implication to units of local government is anticipated.
