The bill would amend the Civil Practice and Remedies to provide that, in an action on a health care liability claim where final judgment is rendered against a rural or community hospital, civil liability for noneconomic damages cannot exceed $100,000. The bill would provide that, in a wrongful death or survival action on a health care liability claim where final judgment is rendered against a rural or community hospital, civil liability cannot exceed $100,000. Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
