The bill would amend the Civil Practice and Remedies Code relating to entity names that might falsely imply governmental affiliation with a governmental unit. The bill provides that, in addition to granting injunctive relief, a court may award certain damages to the governmental unit in certain circumstances upon application by the Secretary of State (SOS) and following consultation with the Office of the Attorney General (OAG)According to the SOS, the agency would need to update certain forms and adopt administrative rules. However, it anticipates that it would be able to undertake those actions using existing resources.According to the OAG, the required review would be relatively narrow and the agency does not anticipate that it would require a significant resource commitment.According to the Office of Court Administration, no significant fiscal impact to the state court system is anticipated.
