The bill would amend the Civil Practice and Remedies Code to allow a court to under certain circumstances issue a temporary restraining order without a formal hearing in a suit to abate certain public nuisances. The bill would also allow, rather than require, a municipality to create a nuisance abatement fund in its treasury. Based on the analysis of the Office of Court Administration and the Secretary of State, it is assumed that duties and responsibilities associated with implementing the bill could be accomplished utilizing available resources. In addition, no significant fiscal impact to the state court system is anticipated with the implementation of the bill.
