The bill would repeal Civil Practice and Remedies Code Section 75.004(b), which applies only to an owner, lessee, or occupant of agricultural land used for recreational purposes who has certain liability insurance coverage in effect.Under Civil Practice and Remedies Code Section 75.003(c), Chapter 75 (limitation of landowners' liability) applies only to an owner, lessee, or occupant of real property who does not charge for entry to the premises, or charges but whose total charges collected are not more than a certain amount, or has certain liability insurance coverage in effect. The bill would eliminate the liability insurance coverage prong for Chapter 75 application.Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
