A BILL TO BE ENTITLED
AN ACT
relating to notice of contamination of a public water supply to
certain water providers by the Texas Commission on Environmental
Quality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
by adding Section 26.0395 to read as follows:
Sec. 26.0395. NOTIFICATION OF CONTAMINATION THREATENING
CERTAIN PUBLIC WATER SUPPLY SYSTEMS. As soon as possible after the
commission detects or becomes aware of contamination of water that
is a source for a public water supply and not later than the time the
commission notifies the news media of the contamination, the
commission shall give notice of the contamination to the owner or
operator of each public water supply system that may be affected by
the contamination.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2021.
