                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             April 21, 2021       TO: Honorable Victoria Neave, Chair, House Committee on Juvenile Justice & Family Issues     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB2308 by Gates (Relating to procedures in certain suits affecting the parent-child relationship filed by the Department of Family and Protective Services.), Committee Report 1st House, Substituted     No significant fiscal implication to the State is anticipated. The bill would amend Family Code to require the Department of Family and Protective Services (DFPS) to provide additional information in an affidavit when taking possession of a child as well as require a court to make certain findings before issuing a temporary order for conservatorship, restraining order, or allowing a governmental entity to take possession of the child. In addition, the bill would allow the alleged perpetrator to agree to an order to leave the residence of the child.    Based on analysis of DFPS and the Office of Court Administration, it is assumed that the costs associated with implementing the provisions of the bill could be absorbed within existing resources.   Local Government ImpactNo fiscal implication to units of local government is anticipated.
