The bill would allow a dentist to delegate the authority to administer certain anesthetic agents to dental hygienists who meet certain criteria. The bill would require the Board of Dental Examiners (TSBDE) to establish education and certification examination requirements for dental hygienists to administer these anesthetic agents.The bill amends the description of the practice of dental hygiene to include administering certain types of anesthesia under the authorization and direct supervision of a dentist.The bill would take effect September 1, 2021.

 Fiscal Analysis

The bill would amend the Occupations Code as it relates to the regulation of the practice of dentalhygiene. The bill would allow a dentist to delegate the authority to administer certain anesthetic agents to dental hygienists who meet certain criteria. Under the provisions of the bill, a dentist may delegate a dental hygienist to administer localanesthesia provided the dental hygienist has completed a certification examination and relatededucational course. In fiscal year 2021, the agency has 14,531 active dental hygienist licenseesand estimates 740 new applicants each year.It is assumed that the provisions of the bill would establish an additional certification. TSBDE estimates that to achieve the intent of the bill, the agency would require an additional FTE for a License and Permit Specialist III which would amount to $62,289 in additional salary and benefit costs in each fiscal year.This analysis assumes that any increased cost to TSBDE, an agency which is statutorily required to generate sufficient revenue to cover its costs of operation, would be offset by an increase in fee generated revenue.

 Technology

TSBDE estimates $2,300 in new employee technology set up expenses which include the costs for a computer, associated software, and a scanner.
