                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             April 20, 2021       TO: Honorable Brooks Landgraf, Chair, House Committee on Environmental Regulation     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB2468 by Thompson, Ed (Relating to programs established and funded under the Texas emissions reduction plan.), Committee Report 1st House, Substituted     The fiscal impact to the state cannot be determined because the amount and terms of fee-based contracts that could be entered into for purchasing nitrogen oxide reductions is unknown. The bill would amend the Health and Safety Code to include the purchase, maintenance, upgrade, and operation of air monitoring equipment in the list of programs eligible to receive a grant through the Texas Emissions Reduction Plan with the Texas Commission on Environmental Quality permitted to expend up to $10.0 million for these purposes to be used in an area or county designated as being in nonattainment. In addition, the bill would allow TCEQ to enter into fee-based contracts for the purchase of reductions of nitrogen oxides under certain conditions as defined in the bill. Based on the analysis of the Comptroller of Public Accounts, the fiscal impact of these contracts cannot be estimated as the terms and amounts of these contracts is unknown. The bill would take effect September 1, 2021.  Local Government ImpactNo significant fiscal implication to units of local government is anticipated.
