The bill would amend the Health and Safety Code to include the purchase, maintenance, upgrade, and operation of air monitoring equipment in the list of programs eligible to receive a grant through the Texas Emissions Reduction Plan with the Texas Commission on Environmental Quality permitted to expend up to $10.0 million for these purposes to be used in an area or county designated as being in nonattainment. In addition, the bill would allow TCEQ to enter into fee-based contracts for the purchase of reductions of nitrogen oxides under certain conditions as defined in the bill. Based on the analysis of the Comptroller of Public Accounts, the fiscal impact of these contracts cannot be estimated as the terms and amounts of these contracts is unknown.
