The bill would amend the Code of Criminal Procedure to require that juries must agree unanimously when finding that a defendant poses a continuing threat to society and when answering no to questions regarding mitigating circumstances.This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources. Based on information provided by the Office of Court Administration, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources and that no significant fiscal impact to the state court system is anticipated due to implementing the provisions of the bill.Based on information provided by the Texas Department of Criminal Justice, no fiscal impact is anticipated as a result of implementing the provisions of the bill.
