                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             April 10, 2021       TO: Honorable Nicole Collier, Chair, House Committee on Criminal Jurisprudence     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB252 by Moody (Relating to certain sentencing procedures in a capital case.), Committee Report 1st House, Substituted     No significant fiscal implication to the State is anticipated. The bill would amend the Code of Criminal Procedure to require that juries must agree unanimously when finding that a defendant poses a continuing threat to society and when answering no to questions regarding mitigating circumstances.This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources. Based on information provided by the Office of Court Administration, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources and that no significant fiscal impact to the state court system is anticipated due to implementing the provisions of the bill.Based on information provided by the Texas Department of Criminal Justice, no fiscal impact is anticipated as a result of implementing the provisions of the bill.  Local Government ImpactNo significant fiscal implication to units of local government is anticipated.
