                    BILL ANALYSIS             C.S.H.B. 2835     By: King, Phil     Land & Resource Management     Committee Report (Substituted)             BACKGROUND AND PURPOSE    There have been calls to codify and amend the powers and duties of the Morningstar Ranch Municipal Utility District No. 1 to help the district better serve the local community. C.S.H.B. 2835 seeks to achieve this goal.       CRIMINAL JUSTICE IMPACT   It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.       RULEMAKING AUTHORITY    It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.       ANALYSIS    C.S.H.B. 2835 amends the Special District Local Laws Code to establish provisions relating to the Morningstar Ranch Municipal Utility District No. 1. The bill grants the district the power to undertake certain road projects and provides for the district's authority to establish defined areas or designated property. The bill authorizes the district, subject to certain requirements, to issue obligations for road projects.       EFFECTIVE DATE    On passage, or, if the bill does not receive the necessary vote, September 1, 2021. The original authorized the district to define areas or designate certain property of the district. The substitute includes a specification absent from the original that this authorization is to pay for improvements, facilities, or services that primarily benefit that area or property and do not generally and directly benefit the district as a whole. The substitute includes an authorization for a defined area to include a noncontiguous tract.
