The bill would amend the Penal Code as it relates to the offense of indecent assault. Under the provisions of the bill, indecent assault would be enhanced to a state jail felony if the actor has been previously convicted of indecent assault or if committed during the course of providing treatment by a health care or mental health service provider as outlined in the bill. Additionally, indecent assault would be enhanced to a third degree felony if the actor was previously convicted as a mental health or health care service provider as outlined in the bill.The Office of Court Administration and Texas Department of Criminal Justice indicate the modifications outlined in the bill's provisions will not result in a significant fiscal impact. This analysis assumes implementing the provisions of the bill addressing felony sanctions would not result in a significant impact on the demand for state correctional resources.
