The bill would amend the Health and Safety Code by adding a chapter for the regulation of referral agencies for senior living communities. The bill would create a civil penalty for a referral agency that violates this chapter, in an amount not less than $250 and not more than $1,000, for each violation. The attorney general would be able to bring an action to recover a civil penalty imposed and to restrain and enjoin a violation of this chapter. The attorney general or a district attorney would be able to recover attorney's fees and litigation costs incurred in bringing the action.The Health and Human Services Commission, the Office of the Attorney General, and the Office of Court Administration indicate any cost to implement provisions of the bill would be minimal and can be absorbed within available resources.
