BILL ANALYSIS H.B. 3089 By: Hull Public Education Committee Report (Unamended) BACKGROUND AND PURPOSE In Texas, the board of trustees of each school district is required to establish a local school health advisory council to assist the district in ensuring that local community values are reflected in the district's health education instruction. These advisory councils are required to meet at least four times each year and provide an annual report to the board of trustees with recommendations on health education curriculum and instruction. Given the importance of the recommendations provided by each advisory council and the requirement to ensure that local community values are reflected in health education instruction, there have been calls to offer the community the opportunity to view and participate in the meetings of the council, just as with meetings of the district's board of trustees or of any other governmental body. H.B. 3089 seeks to promote transparency and community participation by requiring local school health advisory council meetings to be conducted in compliance with state open meetings law. CRIMINAL JUSTICE IMPACT It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
