                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             April 17, 2021       TO: Honorable Jeff Leach, Chair, House Committee on Judiciary & Civil Jurisprudence     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB3318 by Neave (Relating to guardianships, alternatives to guardianship, and supports and services for incapacitated persons.), As Introduced     No significant fiscal implication to the State is anticipated. The bill would require the Office of Court Administration (OCA) to establish by rule a mediation training course that includes at least 24 hours of training for mediators of contested guardianships and related proceedings. Under the bill's provisions, the office could provide the training through a training provider. The training would not be mandatory for a person to mediate a contested guardianship. The bill would also include procedures for consideration of alternatives to guardianship for contested guardianships in mediation. The bill would create procedures for terminating guardianship under certain circumstances and revises provisions regarding the transfer of a guardianship from one county to another.Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
