The bill would amend the Civil Practice and Remedies Code to provide that a party may not assert a claim in an arbitration proceeding if the party could not bring suit for the claim in court due to the expiration of the applicable limitations period. The bill would provide that a party may assert a claim in an arbitration proceeding after expiration of the application limitations period if the party brought suit for the claim in court before the expiration of the applicable limitations period and the parties to the claim agreed to arbitrate the claim or a court ordered the parties to arbitrate the claim.Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
