The bill would amend the Health and Safety Code to provide that the notice required to be given under the Texas Mental Health Code may be given by personal delivery of a copy of the notice or document by a constable or county sheriff.The bill would also provide that, in certain court proceedings involving persons with mental illness, a person may file a reproduced, photocopied, or electronically transmitted application, petition, certificate, or other paper with the county clerk but must maintain in possession of the original signed copies and produce them for inspection upon request. The bill would also repeal the provision that allows the judge to dismiss the proceeding upon failure to timely give the clerk an original, signed copy of the paper. Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
