                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             April 12, 2021       TO: Honorable Chris Turner, Chair, House Committee on Business & Industry     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB3746 by Capriglione (Relating to certain notifications required following a breach of security of computerized data.), As Introduced     No significant fiscal implication to the State is anticipated. The bill amends the Business & Commerce Code relating to certain notifications required following a breach of security of computerized data. The bill would require that persons who are required to provide notice of a data breach to the Office of the Attorney General must include in the notice information disclosing the number of affected residents to whom a disclosure of the breach has been provided by mail or other direct method. The bill requires the Office of the Attorney General to post on its website a comprehensive listing of all data breach notices received by the Office of the Attorney General within 30 days of the office's receipt of such notice. The posting would exclude any reported sensitive personal information.According to the Office of the Attorney General, any additional work resulting from the provisions of the bill could be absorbed within current resources.
