A BILL TO BE ENTITLED
AN ACT
relating to fees levied by municipalities and counties for
alcoholic beverage permits and licenses.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 11.38, Alcoholic Beverage Code, is
amended by adding Subsection (a-1) to read as follows:
(a-1) The fee authorized by Subsection (a) for a permit
effective in statute on or after September 1, 2021, may not exceed
10 percent of the fee set by rule for the permit.
SECTION 2. Section 61.36, Alcoholic Beverage Code, is
amended by adding Subsection (a-1) to read as follows:
(a-1) The fee authorized by Subsection (a) for a license
effective in statute on or after September 1, 2021, may not exceed
10 percent of the fee set by rule for the license.
SECTION 3. This Act takes effect September 1, 2021.
