 A BILL TO BE ENTITLED
 AN ACT
 relating to the designation of certain premises as critical load.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter D, Chapter 38, Utilities Code, is
 amended by adding Section 38.074 as follows:
 Sec. 38.074.  CRITICAL LOAD DESIGNATION. (a) The
 commission by rule shall establish a process for priority of
 designation and eligibility requirements for a transmission and
 distribution utility to designate a premise as critical load. The
 commission shall coordinate with other agencies with primary
 jurisdiction over entities with critical load designation
 premises.
 (b)  In providing eligibility requirements under Subsection
 (a), the commission shall include premises for upstream natural gas
 production, midstream natural gas transportation, fuel production,
 nitrogen supply, hydrogen supply, water supply, and
 telecommunications.
 (c)  The commission shall make an annual report to the
 legislature regarding critical load entity designation, including
 implementation and results, beginning no later than January 1,
 2022.
 SECTION 3.  The Public Utility Commission shall adopt rules
 as required by Section 38.074 Utilities Code, as added by this Act,
 not later than September 1, 2021 if the Act takes immediate effect.
 The Public Utility Commission shall adopt rules as required by
 Section 38.074, Utilities Code, as added by this Act, not later than
 November 1, 2021 if the Act takes effect September 1, 2021.
 SECTION 4.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article II, Texas Constitution. If this Act
 does not receive the vote necessary for immediate effect, this Act
 takes effect September 1, 2021.
