By: Romero, Jr. H.B. No. 3990 A BILL TO BE ENTITLED AN ACT relating to the report of right-angle collisions of vehicles. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter E, Chapter 550, Transportation Code, is amended by adding Section 550.082 to read as follows: Sec. 550.082. Report of Right-Angle Collision; Traffic Study. (a) This section applies only to an intersection of roadways at least one of which is part of the state highway system or of a roadway that is part of the state highway system with an alley or driveway and only if the intersection is not controlled by a traffic-control signal. (b) A law enforcement officer who investigates a right-angle collision at an intersection shall file a written report stating the occurrence and location of the collision with: (1) the Texas Department of Transportation; and (2) if the collision occurred in a municipality, the municipal police department of the municipality. (c) If during any 12-month period a governmental entity receives under this section 10 or more reports of right-angle collisions that occur at the same intersection, the governmental entity shall perform a traffic study of that location and shall take the actions that the governmental entity determines reasonable and necessary to improve the safety at the location. (d) The information collected under this section is privileged from discovery, is confidential for purposes of Chapter 552, Government Code, and is not admissible in a court on any issue of liability. This section does not waive sovereign immunity and has no effect on any of the exclusions and exceptions contained in Chapter 101, Civil Practices and Remedies Code (e) In this section: (1) "Right-angle collision" means a motor vehicle collision in which the side of one vehicle is struck by the front or rear of another vehicle. (2) "Roadway" means a street, road, or highway. SECTION 2. This Act takes effect September 1, 2021.
