                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             May 6, 2021       TO: Honorable Victoria Neave, Chair, House Committee on Juvenile Justice & Family Issues     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB3994 by Neave (Relating to the modification of a disposition by a juvenile court after a childs violation of a condition of probation.), Committee Report 1st House, Substituted     No significant fiscal implication to the State is anticipated. The bill would amend the Family Code to prohibit a juvenile court from modifying the disposition of a child on probation to order placement of the child in a juvenile facility based solely on a finding the child engaged in non-criminal conduct, unless the conduct indicates the child may be a danger to themselves or threaten public safety or the placement would be in a facility specifically designated to treat certain diagnosed conditions.Based on the analysis of the Office of Court Administration and the Juvenile Justice Department, it is assumed that duties and responsibilities associated with implementing the bill could be accomplished utilizing available resources. In addition, no significant fiscal impact to the state court system is anticipated with the implementation of the bill.  Local Government ImpactNo significant fiscal implication to units of local government is anticipated.
