A BILL TO BE ENTITLED
AN ACT
relating to providing a list of approved devices to defendants
restricted to the operation of a vehicle equipped with an ignition
interlock device as a condition of community supervision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Article 42A.408, Code of Criminal Procedure, is
amended by adding Subsection (i) to read as follows:
(i) A defendant ordered to install an interlock device as a
condition of community supervision shall have the ability to choose
from among any interlock provider approved by the Department of
Public Safety as provided by subsection (g) of this section.
SECTION 2. The Department of Public Safety shall publish a
list of approved ignition interlock devices as required by Article
42A.408(g-1), Code of Criminal Procedure, as added by this Act, not
later than December 1, 2021.
SECTION 3. The change in law made by this Act applies only
to a defendant placed on community supervision on or after January
23 1, 2021.
SECTION 4. This Act takes effect September 1, 2021.
