                    LEGISLATIVE BUDGET BOARD     Austin, Texas       FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION             April 7, 2021       TO: Honorable Briscoe Cain, Chair, House Committee on Elections     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB4331 by Jetton (Relating to creating criminal offenses; providing a civil penalty for paid vote harvesting.), As Introduced     No significant fiscal implication to the State is anticipated. The bill would amend the Election Code as it relates to the offense of organized election fraud in the form of paid vote harvesting.  Under the provisions of the bill, election fraud would be expanded to include paid vote harvesting be punishable by a felony of the third degree.  Under existing statute, election fraud is punishable by a Class A Misdemeanor.The Office of Court Administration indicates the modifications outlined in the bill's provisions would not result in a significant fiscal impact.  This analysis assumes implementing the provisions of the bill addressing felony sanctions would not result in a significant impact on the demand for state correctional resources.
