The bill would amend Chapter 2303 of the Occupations Code to stipulate that the operator of a vehicle storage facility has a first priority possessory lien on a vehicle and its contents for all charges for all reasonable towing, recovery, and storage fees, including all fees set by law or rule, for which the owner, operator, or carrier is liable. The lien would not extend or attach to certain personal items and would require these items to be released without charge to the owner or operator of the motor vehicle or the owner or operator's duly authorized representative.Based on the analysis provided by the Department of Licensing and Regulation and the Department of Motor Vehicles, it is assumed the provisions of the bill would not result in a significant operational or fiscal impact to the agencies or the State.
