BILL ANALYSIS H.B. 4639 By: Bell, Cecil Urban Affairs Committee Report (Unamended) BACKGROUND AND PURPOSE It has been suggested that the Conroe Municipal Management District No. 1 be granted the powers and duties of a levee improvement district in order for the district to perform floodplain reclamation activities. H.B. 4639 grants these powers and duties to the district. CRIMINAL JUSTICE IMPACT It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 4639 amends the Special District Local Laws Code to establish provisions relating to the Conroe Municipal Management District No. 1, which was created as a municipal management district by an order of the Texas Commission on Environmental Quality (TCEQ) on April 21, 2015. H.B. 4639 entitles a district director to receive fees of office and reimbursement for actual expenses as provided by specified Water Code provisions generally applicable to all water districts. The bill exempts the district's board of directors from municipal management district provisions that do the following: prohibit a position on the board of directors of a municipal management district from being construed to be a civil office of emolument for any purpose; and establish that a municipal management district director is not entitled to compensation for service on the board but is entitled to be reimbursed for necessary expenses incurred in carrying out the duties and responsibilities of a director. H.B. 4639 grants the district the powers and duties provided by the general law of the state applicable to municipal management districts created under specified Texas Constitution provisions. The bill establishes that the district has the powers and duties necessary to accomplish the purposes for which the district is created.
