The bill would amend the Code of Criminal Procedure by prohibiting a justice or judge from imposing a fine and court costs on a defendant who is under the conservatorship of the Department of Family and Protective Services (DFPS) or in extended foster care. In lieu of a fine the justice or judge may require the defendant to perform community service.Based on information provided by the Office of Court Administration, the analysis assumes implementing the provisions of this bill may reduce the recovery of fines and court costs in a narrow set of cases, it is anticipated that very few costs are collected from this population and no significant fiscal impact to the state court system is expected.Based on the analysis of DFPS, no fiscal impact is assumed associated with implementing the provisions of the bill. The Comptroller of Public Accounts assumed the bill would have no significant fiscal impact to the state.
