This bill would amend Section 1701.655(b) of the Occupations Code to require that a law enforcement agency's (LEA) body worn camera (BWC) policy include provisions treating a BWC, and associated video and audio recorded by the camera, as evidence. This bill would require that a LEA's BWC policy must include a provision requiring certain peace officers to keep a BWC activated for the entirety of the investigation, unless the camera has been deactivated in compliance with the LEA's BWC policy.The Alcoholic Beverage Commission and Texas Commission on Law Enforcement indicate the modifications outlined in the bill's provisions would not result in a significant fiscal impact. This analysis assumes the costs to the Department of Public safety associated with implementing the bill's provisions could be absorbed using existing resources. This analysis assumes implementing the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources.
