The bill would amend Texas Water Code to alter the definition of affected person for purposes of an administrative hearing related to the Texas Commission on Environmental Quality (TCEQ). For purposes of contested cases on applications to TCEQ for environmental permits, members of the legislature for the area where the proposed facility would be located, or to which it "relates," would be "affected persons" entitled to be parties in the case. Based on the analysis of the TCEQ and the Office of Administrative Hearings, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be absorbed with existing resources.
