The bill would amend the Penal Code as it relates to failure to report assault, neglect, or omission of care in certain group homes. Under the provisions of the bill, a person who has reasonable cause to believe a resident of a group home suffered bodily injury due to assault, neglect or omission in care and fails to report this to law enforcement or the Department of Family and Protective Services would commit a state jail felony. The actor can be prosecuted under this section, another law, or both. The Office of Court Administration, Health and Human Services Commission, and Department of Family and Protective Services indicate the modifications outlined in the bill's provisions would not result in a significant fiscal impact. This analysis assumes implementing the provisions of the bill addressing felony sanctions would not result in a significant impact on the demand for state correctional resources.
