The bill would amend Health and Safety Code to require end stage renal disease facilities exempt from licensing to meet certain conditions in order to be exempt from licensing. The bill would also allow dialysis technicians to provide home dialysis care, including hemodialysis, under certain conditions. The bill would require the executive commissioner of the Health and Human Services Commission to adopt rules as necessary.The Health and Human Services Commission indicates any cost related to rulemaking would be minimal and could be absorbed within available resources. It is unknown how many end stage renal disease facilities that are currently exempt would no longer be exempt and would now be required to obtain licensure. It is unknown how many additional full-time equivalents would be needed for Health Care Regulation to conduct licensing and compliance activities for additional end stage renal disease facilities and an estimate cannot be determined at this time.
