Kolkhorst, Chair, Senate Committee on Health & Human Services     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: SJR19 by Kolkhorst (Proposing a constitutional amendment establishing a right for certain residents receiving care in residential settings to designate an essential caregiver for in-person visitation.), Committee Report 1st House, Substituted     No fiscal implication to the State is anticipated, other than the cost of publication.  The cost to the state for publication of the resolution is $178,333. The joint resolution proposes a constitutional amendment to Article I of the Texas Constitution that would establish the right for a resident of a nursing facility, assisted living facility, intermediate care facility for individuals with an intellectual disability, residence providing home and community-based services, or state supported living center, to designate at least one essential caregiver with whom the facility, residence, or center may not prohibit in-person visitation. The cost to the state for publication of the resolution is $178,333 in fiscal year 2022.The proposed amendment would be submitted to voters at an election to be held November 2, 2021.
