 A BILL TO BE ENTITLED
 AN ACT
 relating to prohibiting the use of state or federal money for the
 purpose of certain instruction at public institutions of higher
 education.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter Z, Chapter 51, Education Code, is
 amended by adding Section 51.979 to read as follows:
 Sec. 51.979.  USE OF STATE OR FEDERAL MONEY PROHIBITED FOR
 CERTAIN INSTRUCTION. (a) In this section, "institution of higher
 education" has the meaning assigned by Section 61.003.
 (b)  Notwithstanding any other law, an institution of higher
 education may not use appropriated state or federal money to offer a
 course, component of a course, unit of study, or other instruction
 that directs or otherwise compels a student to personally affirm,
 adopt, or adhere to the idea that:
 (1)  any race, sex, ethnicity, religion, color, or
 national origin is inherently superior or inferior to another race,
 sex, ethnicity, religion, color, or national origin;
 (2)  an individual should be discriminated against or
 receive adverse treatment solely or partly because of the
 individual's race, sex, ethnicity, religion, color, or national
 origin; or
 (3)  an individual, by virtue of the individual's race,
 sex, ethnicity, religion, color, or national origin, is inherently
 responsible for actions committed in the past by other members of
 the same race, sex, ethnicity, religion, color, or national origin.
 SECTION 2.  This Act applies beginning with the 2022 spring
 semester.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect on the 91st day after the last day of the
 legislative session.
