 A JOINT RESOLUTION
 proposing a constitutional amendment requiring the state to develop
 and seek appropriate authorization under the federal Medicaid
 program to implement the Live Well Texas program to provide health
 benefit coverage to certain individuals.
 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Article XVI, Texas Constitution, is amended by
 adding Section 74 to read as follows:
 Sec. 74.  (a)  As provided by general law, the state shall
 develop and seek a waiver under Section 1115 of the Social Security
 Act (42 U.S.C. Section 1315) to the state Medicaid plan or other
 appropriate federal authorization to implement the Live Well Texas
 program to assist individuals for whom federal matching funds are
 available to the state under the Patient Protection and Affordable
 Care Act (Pub. L. No. 111-148) as amended by the Health Care and
 Education Reconciliation Act of 2010 (Pub. L. No. 111-152) or other
 federal law in obtaining health benefit coverage.
 (b)  The terms of the waiver or other authorization described
 by Subsection (a) of this section must be designed in a manner that
 leverages available federal medical assistance percentage funding
 under the federal Medicaid program, including funding available
 under the American Rescue Plan Act of 2021 (Pub. L. No. 117-2).
 SECTION 2.  The following temporary provision is added to
 the Texas Constitution:
 TEMPORARY PROVISION. (a) This temporary provision applies
 to the constitutional amendment proposed by the 87th Legislature,
 3rd Called Session, 2021, requiring the state to develop and seek
 appropriate authorization under the federal Medicaid program to
 implement the Live Well Texas program to provide health benefit
 coverage to certain individuals.
 (b)  Section 74, Article XVI, of this constitution takes
 effect January 1, 2023.
 (c)  This temporary provision expires January 1, 2024.
 SECTION 3.  This proposed constitutional amendment shall be
 submitted to the voters at an election to be held November 8, 2022.
 The ballot shall be printed to provide for voting for or against the
 proposition: "The constitutional amendment requiring the state to
 develop and seek appropriate authorization under the federal
 Medicaid program to implement the Live Well Texas program to
 provide health benefit coverage to certain individuals."
