The bill would amend the Health and Safety Code to prohibit a facility from confiscating or misappropriating an eligible federal payment made to a resident who is a recipient of Medicaid. A facility that violates this provision would be subject to an administrative penalty in an amount equal to $25,000 for each violation.The Health and Human Services Commission indicates any cost to implement provisions of the bill would be minimal and can be absorbed within available resources.
